Friday, Sept. 20 — It wasn’t what they’d hoped for, but Maria and Gordon “Steve” Green will at least temporarily get to visit their 7-month-old daughter more often.

The couple, who are both medical marijuana patients (Maria Green is also a caregiver), are fighting to regain custody of their daughter, Brielle, after she was removed from the Greens’ home last week.

A hearing today before Ingham County Probate Judge Richard Garcia reviewed a decision last week by an attorney referee to at least temporarily remove Bree from the Greens’ home.

Child Protective Services petitioned to have Bree removed based on allegations from Maria Green’s 6-year-old son from a previous marriage that there were marijuana plants growing, and that visitors openly smoked marijuana, in the house. The Greens have denied that anyone smoked in front of children at their home.

Over the past week, the Greens were able to see Bree for three separate one-hour visits. Garcia ruled today that the Greens could visit Bree as much as they wanted, but he did not return the child back in their custody as they sought.

A jury trial is scheduled for Oct. 7 that will determine whether Steve and Maria Green can regain custody.

The Greens were emotional outside of Garcia’s courtroom today about the ordeal, but Maria Green called the decision to be able to see her daughter anytime a “silver lining.”

“I will now be able to go spend more than three hours a week with her,” she said.

See here for more on the Greens’ story. A half-hour interview with the Greens airs on "City Pulse Newsmakers" Sunday at 10 a.m. on My18-TV.
